Welcome to Paage, a platform that allows you to create and share a personalized page with links, videos, photos, and paid products. These Terms and Conditions govern your use of our website, services, and associated platforms ("Paage"). By accessing or using Paage, you agree to these Terms. If you do not agree, please discontinue using the platform.
Introduction
By accessing Paage, you agree to be bound by these Terms and Conditions (“Terms”) and all applicable laws. These Terms contain the agreement between you and Paage in respect of the platform described below. Please read these Terms carefully. Please also read our Privacy Policy and Community Guidelines. You form a contract with us when you confirm that you accept these Terms or when you otherwise use the platform. These Terms apply to all users of Paage, including visitors, registered users, and those who interact with Paage in any capacity.
Who you are contracting with
The company that you are contracting with is LAMA (trading under the website paa.ge), a simplified joint stock company with capital of €20,000 registered with the Grenoble Trade and Companies Register under number 885 091 876, with registered office located at 134 rue d’Aubervilliers, 75019, Paris, France.
Your account
To create a Paage account, you must be at least 18 years old. You are responsible for the confidentiality of your login information and the activity on your account. If you create an account on behalf of another person or entity, you confirm that you have the necessary authority to agree to these Terms on their behalf.
You agree to provide accurate and complete information during the registration process and to update this information as needed. You are solely responsible for any activity under your account and must notify us immediately if you suspect unauthorized access to your account.
Changes to These Terms
We may modify these Terms periodically to reflect changes to our services, policies, or applicable laws. If we make significant changes, we will notify you in advance. Your continued use of Paage after any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using Paage.
Your Content
We value the variety of content shared by users on Paage. However, we have Community Guidelines to ensure a safe environment for everyone. By posting content, you agree to abide by these standards.
Your Content Responsibility:
Ownership or Permission: You confirm that you either own the content you post or have the necessary rights to use and share third-party content. You grant Paage a license to use, distribute, display, modify, and create derivative works from your content on our platform and in marketing materials.
Respect for Others’ Rights: Your content will not infringe on any privacy, publicity, intellectual property, or other legal rights of individuals or entities.
Accuracy and Honesty: Your content must be truthful and not misleading. It should not violate any local or international laws or damage Paage’s reputation.
Security: Your content must not contain harmful elements like viruses or malicious code.
No Automated Data Collection: You are not permitted to use bots, scripts, or scraping tools to gather data from Paage or other users.
No Unauthorized Ads or Solicitation: Advertising, promotions, or endorsements are not allowed unless explicitly approved by Paage.
You are responsible for ensuring your content aligns with Paage's Community Guidelines. Failure to do so may result in content removal, account suspension, or permanent termination.
Prohibited Content:
Content that is hateful, discriminatory, violent, or promotes illegal activities.
Nudity or adult content that does not comply with local laws or Paage’s Community Guidelines.
Content that infringes upon intellectual property laws, such as pirated material.
We may remove or restrict access to content that violates these standards, and in cases of repeated violations, suspend or terminate your account.
Commerce and Payment Processing Fees
Subscription Fees:
If you choose a paid plan on Paage, you must pay the applicable subscription fees in a timely manner. Fees are charged in EUR € or USD $, including applicable taxes (e.g., VAT/GST). Subscription fees are billed in advance based on your chosen billing cycle (monthly or annually). Your plan will automatically renew unless you cancel it before the next billing cycle begins.
You must provide accurate billing information and a valid payment method (e.g., credit card). In case of payment failure, we will notify you, and the invoice must be settled within a specified time to avoid service suspension.
Transaction Fees:
Paage may apply a percentage-based transaction fee for transactions conducted on your profile, including sales of physical or digital products. The specific transaction fees depend on your subscription plan and are outlined on our pricing page. These fees will be deducted from your sales proceeds before you receive the funds.
Processing Fees:
Any fees imposed by external payment processing services (e.g., Stripe, PayPal) are your responsibility. These processing fees will also be deducted before the funds are transferred to you. It is your responsibility to review and comply with the terms of each payment processor. Paage is not responsible for any changes to these external fees or terms.
Changes in Fees and Advance Notice:
Paage may adjust subscription or transaction fees periodically. If we make changes, we will notify you at least 30 days in advance. If you disagree with the updated fees, you may cancel your subscription before the next billing cycle.
Your Username
When creating a username, you must choose one that is respectful of others’ rights, including intellectual property rights. You cannot impersonate individuals, brands, or use offensive, vulgar, or otherwise inappropriate usernames. Paage reserves the right to request username changes, suspend, or terminate accounts with violations.
Monetization of Your Content
Paage provides features to sell products and services directly from your page. You are responsible for ensuring compliance with all applicable laws regarding the products or services you sell, including consumer protection, data protection, and taxation.
If you participate in monetization programs, you agree to disclose commissions and follow all legal requirements in your territory. Paage is not responsible for your compliance with these obligations. Payments made through our monetization partners will be subject to their own terms and processing fees.
Privacy and Data Protection
Paage values your privacy. By using our platform, you agree to our Privacy Policy, which outlines how we collect, use, and protect your personal information. You are responsible for complying with applicable data protection laws in relation to your customers and visitors.
Termination of Account
Paage reserves the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, harmful, or inappropriate behavior. In the event of account termination, you are not entitled to a refund for any prepaid subscription fees. Any content you have uploaded may be removed or disabled without notice.
Limitation of Liability
Paage is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, about the platform’s availability, functionality, or reliability. To the fullest extent permitted by law, Paage disclaims liability for indirect, incidental, or consequential damages arising from your use of the platform.
You agree to indemnify and hold harmless Paage from any claims, damages, or losses resulting from your breach of these Terms or your content’s violation of any third-party rights.
Intellectual Property
Paage retains all rights to its platform, including its software, logos, and content created by us. You may not copy, modify, distribute, or reverse-engineer any part of Paage without our prior written consent. You retain ownership of the content you post but grant Paage a license to use it as described in these Terms.
